Terms of Use

1. Acceptance of these terms

By installing, opening, or otherwise using the Taksa mobile application (the "App"), the taksa.app website, the assets.taksa.app content delivery network, or any other service provided under the Taksa name (collectively, the "Services"), you agree to these Terms of Use. If you do not agree, do not install or use the Services and uninstall the App if you have already installed it.

2. The Taksa mission

Taksa exists to preserve, organize, and share the sacred liturgical life of the Chaldean Catholic Church. The prayers, hymns, lectionaries, sacraments, and translations made available through the App represent generations of devotion and the careful work of clergy, scholars, and faithful contributors. These terms exist to keep that work intact, attributed, and freely available for prayer and study — and to prevent it from being misappropriated.

3. Limited license to use the App

Subject to your compliance with these terms, you are granted a personal, non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to install and use the App on devices you own or control, solely for your own personal devotional, educational, and liturgical use.

This license does not grant you any right of ownership in the App or its content, and is the entire scope of permission you receive.

4. Ownership of content — "All rights reserved"

Everything made available through the Services — including the liturgical texts, English and Sureth translations, transliterations, audio recordings, hymns, chants, lectionary cycles, calendar data, HTML compositions, PDF arrangements, illustrations, icons, the Taksa name, the Taksa logo and branding, the user interface, the app code, the website, and the structured organization of the entire content library — is protected by copyright, trademark, and other intellectual-property laws.

Some of this content is owned by Taksa and its developers. Other portions are owned by their original copyright holders (the Chaldean Catholic Church and its eparchies, individual translators, hymnographers, performers, and recording engineers, the publishers of liturgical books, and the licensors of the typefaces used in the App, including Beth Mardutho: The Syriac Institute, the SIL Open Font License contributors for Inter, Outfit, and Noto Naskh Arabic). All such rights are reserved by those rights-holders.

Nothing in the Services may be replicated, copied, redistributed, mirrored, scraped, or otherwise taken without explicit written permission. Receiving content through the App is not permission to extract or reuse it.

5. What you may not do

Without prior written permission from Taksa (and, where applicable, from the original rights-holder), you may not:

The fact that a particular use is not enumerated above does not mean it is permitted. The default rule is: if a use goes beyond personal devotion or study on your own device, ask first.

6. Personal devotional use is welcome

To be clear about what is permitted: pray with the App, study with it, follow along during the Mass, share a screenshot with a friend, mention the App to your parish, leave a review. Show the App to your priest or your children. Cache audio for a long flight. Use it in catechism or Sunday school. The intent of these terms is to prevent extraction and misappropriation, not to limit the prayerful use the App was made for.

If you are clergy, a parish, an eparchy, a school, a publisher, or a researcher and you would like to use Taksa content beyond what these terms allow, please write to us. Reasonable requests with a clear pastoral or scholarly purpose are usually welcome.

7. User feedback

If you send us feedback, suggestions, corrections, or proposed contributions ("Feedback"), you grant Taksa a perpetual, irrevocable, worldwide, royalty-free license to use that Feedback for any purpose related to improving the App and its content. We are not obligated to use, credit, or respond to any Feedback, but we are grateful when you send it.

8. Accuracy and pastoral authority

The App is offered as a reference and a companion. While every effort is made to faithfully present the liturgical texts of the Chaldean Catholic Church, no digital edition is authoritative. For matters of liturgical practice, sacramental discipline, or doctrine, consult your priest or eparchy. If you notice an error, please report it.

9. No warranty

The Services are provided "as is" and "as available," without warranty of any kind, express or implied — including, without limitation, any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or uninterrupted availability. Audio playback depends on your network connection. Liturgical calendar dates are calculated and may differ from local pastoral usage.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Taksa, its developers, contributors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or use, arising out of or related to your use of the Services — even if advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the greater of (a) the amount you paid for the App in the 12 months preceding the claim (the App is free, so this amount is typically zero) or (b) US $10.

11. Indemnification

You agree to indemnify, defend, and hold harmless Taksa and its developers from any claim, damage, liability, cost, or expense (including reasonable attorneys' fees) arising out of your breach of these terms or your misuse of the Services or its content — in particular, any unauthorized copying, redistribution, or commercial use of Taksa content.

12. Enforcement and copyright complaints

Taksa actively enforces the rights described in these terms. If we discover unauthorized copies of the App's content — whether on a website, a podcast feed, an app store, a YouTube channel, a training dataset, or anywhere else — we will pursue removal through the relevant platform's takedown process and, where appropriate, through legal action.

If you believe content in the App infringes a copyright you hold, please send a written notice to [email protected] that identifies (a) the work claimed to be infringed, (b) the location of the allegedly infringing content within the App, (c) your contact information, (d) a statement that you have a good-faith belief the use is unauthorized, and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on the rights-holder's behalf.

13. Third-party services

The App is distributed through the Apple App Store and the Google Play Store and uses Amazon Web Services, CloudFront, and Cloudflare for hosting. Your use of the App is also subject to the terms of those platforms.

14. Termination

We may suspend or terminate your access to the Services at any time, including for any breach of these terms. You may end your relationship with the Services at any time by uninstalling the App. Sections 4, 5, 7, 9, 10, 11, and 12 survive termination.

15. Governing law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Any dispute arising from these terms or the Services will be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

16. Changes

We may update these terms from time to time. Material changes will be reflected here with a new "Last updated" date. Your continued use of the Services after a change takes effect constitutes acceptance of the revised terms.
